自 2023 年12 月 6 日起,FairWork实施了关于定期合同个人就业的新规定。以下是关键点:

什么是固定期限合同
固定期限合同是雇主和雇员之间的协议,在明确定义的期限(例如指定的日期或时间范围)结束协议。

新法规
自2023年12月6日之后建立的固定期限合同,其期限不得超过2年,包括延期或续签。合同不能提供多个延长或续签的选择权,确保总雇佣期不超过2 年。值得注意的是,这些规定不适用于临时雇员。

雇主保留将固定期限雇员永久聘用或在初始期限后提供新的固定期限合同的选择,前提是不是为相同或类似的工作。雇主必须及时向固定期限员工提供固定期限合同公平工作信息声明。

例外情况和注意事项
新规定包括例外情况,如《固定期限合同公平工作信息声明》所述。这些例外情况包括特定任务的专业技能、培训安排、必要工人、高收入者、治理职位以及现代奖励规定允许的情况。

Fixed-Term Contracts
Since 6 December 2023, Fair Work has implemented new regulations governing the employment of individuals on fixed-term contracts. Here are the key points:

1.     Employers are restricted from engaging someone on a fixed-term contract that exceeds 2 years, includes more than one extension option, or involves consecutive contracts. These changes only pertain to fixed-term contracts initiated after 6 December 2023, and do not affect casual employees on fixed-term arrangements.
2.     There are exceptions to the new rules for specific categories of employees. All employees under fixed-term contracts must be provided with the Fixed Term Contract Fair Work Information Statement.

What Constitutes a Fixed-Term Contract
A fixed-term contract is an agreement betweenan employer and an employee that concludes at the conclusion of a clearly defined period, such as a specified date or timeframe.

New Regulations
For fixed-term contracts established after 6 December 2023, they cannot surpass 2 years, including extensions or renewals.The contract cannot offer more than one option to extend or renew, ensuring the total employment period does not exceed 2 years. It is noteworthy that these provisions do not apply to casual employees.

Employers retain the option to hire fixed-term employees on a permanent basis or offer a new fixed-term contract after the initial term, provided it is not for the same or similar work. The Fixed Term Contract Fair Work Information Statement must be promptly provided to fixed-term employees.

Exceptions and Considerations
The new regulations feature exceptions, asoutlined in the Fixed Term Contract Fair Work Information Statement. These exceptions include specialized skills for specific tasks, training arrangements, essential workers, high-income earners, governance positions, and situations where Modern Award provisions permit.
